No fewer than 11 states and a pair of regions have complied with a recent directive from the federal government to remove references of gender identity and the existence of transgender and non-binary individuals from a national sexual health program, officials stated.
The administration established a Monday deadline for stripping these references, threatening the withdrawal of substantial government funding. Almost every of the agreeing jurisdictions have GOP-led state legislatures and predominantly Republican governors.
An additional sixteen jurisdictions and the nation's capital have filed a lawsuit challenging the administration's demand, claiming it infringes on Congressional authority, which created the $75 million sexual health initiative, known as the PREP initiative.
All jurisdictions involved in the legal challenge are led by Democrat governors.
In a recent judicial ruling, a federal judge prevented the HHS agency, which manages the program, from withholding funding to the suing jurisdictions if they refuse to comply.

In April, the Trump administration demanded all states and territories obtaining Prep funds to submit a copy of their educational materials to the department and its agency, the Administration for Children and Families, for a “medical accuracy review”.
By late summer, the government dispatched notices to 46 states and territories, stating that, during the review, it had found “material in the educational programs that deviate from the scope of Prep’s authorizing statute.”
Specifically, the government said it had uncovered evidence of “gender ideology,” a term often used by conservative groups to describe the idea that identity is a changeable cultural concept and that trans and non-binary people are real.
The administration directed Illinois to remove a curriculum that said: “Young people may identify in ways that don’t conform with their biological sex.”
It told another state to delete a line from a educational module that read: “Individuals regardless of identity need to know how to prevent unplanned pregnancy and infections.”
Additionally, health instructors in numerous states could no longer be instructed to “show tolerance and understanding for all participants, regardless of personal characteristics, including race, heritage, faith, economic status, orientation or gender identity,” based on the letters dispatched to states.
“Accountability is coming,” said a federal official, acting assistant secretary of the Administration for Children and Families, in a announcement. “Government money will not be used to poison the minds of the youth or promote dangerous ideological agendas.”
Several jurisdictions and territories stated they would remove the content or had already done so. These include Alaska, Georgia, Iowa, Kentucky, Mississippi, North Carolina, Oklahoma, South Carolina, Tennessee, West Virginia and Wyoming, as well as the two territories.
Another pair of jurisdictions, Alabama and South Dakota, said their educational programs never contained the terminology mentioned in the administration’s letters.

Nearly half of transgender adolescents seriously considered suicide in the previous twelve months, based on a 2024 survey from a suicide-prevention group. Educational backing for these youths is associated with reduced numbers of self-harm attempts, the group found.
Earlier this year, the Trump administration instructed a state to remove mentions to gender identity from its educational program.

The California health department is challenging the withdrawal. So far, it has been unsuccessful in replace the withdrawn money.
